NY Ignores August 8 Deadline for UST Operator Training
The federal
Energy Policy Act of 2005 required operators of underground petroleum
bulk storage tanks to obtain "operator training" by August 8, 2012. But Congress left it to the states to implement this requirement.
Neighboring states have done so, but to date, New York's Department of Envrironmental Conservation has not established a timetable or defined a standard for such training, so there's no need for New York retailers to worry about the deadline passing.
The state Petroleum Bulk Storage Advisory Council, chaired by NYACS Treasurer Case Marshall, has urged DEC to inform retailers about their plans for operator training, and DEC is expected to issue a "Tank Bulletin" on the subject shortly.
As soon as DEC gets its act together, NYACS will advise you. Until then, don't sweat the August 8 date.
