State Authorizes Half-Gallon Pricing by Permit

The New York State Bureau of Weights and Measures is now accepting applications from retailers for temporary permission to price by half-gallon at pumps incapable of displaying prices above $3.
Interested retailers can download a simple, one-page application from the Bureau's web site and fax it in to obtain approval. Weights and Measures is confident they can process your application quickly, possibly the same day.
There are conditions.
• The permit is valid for 60 days.
• You must display it in your window.
• You have to follow certain signage requirements explained on the application.
• You have to be making an honest effort to get the equipment upgrade necessary to enable the pump to display $3 prices.
Many New York retailers have mechanical pumps for gas and/or diesel that cannot currently display $3-a-gallon prices. Kits to provide this capability can be ordered but will take awhile to arrive. The best alternative in the interim is to post the price per half-gallon and make sure there is adequate and accurate signage making this clear to consumers.
