MEMORANDUM IN OPPOSITION

 

A.3637 by Member of Assembly John

AN ACT to amend the labor law, in relation to

enacting the "New York State Fair Pay Act"

 

 

The New York Association of Convenience Stores represents the interests of 6,000 neighborhood mini-marts and convenience stores – many of them independent, family-run enterprises – from Chili to Chatham.

As responsible employers and fair-minded citizens, we share the commitment of the sponsors and every New Yorker to making sure qualified workers receive comparable pay for comparable work in comparable markets, regardless of gender or race.

But the reporting requirements prescribed by A.3637 cross the line from trying to ensure wage equality to breaching the confidentiality of employer decisions on compensation.

State government has no business requiring a private company to publicly disclose its "method, system, calculations, and other bases used to establish, adjust, and determine" wage rates.

Accordingly, NYACS respectfully opposes passage of this legislation.
